We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify you of material changes via email or in-app notice.
You must be at least 13 years old to use MiniMagic. If you are between 13 and 18 years old, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
You are responsible for maintaining the security of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
You may not create multiple accounts to abuse free credits, promotional offers, or circumvent usage limits. We reserve the right to terminate accounts engaged in such activity.
MiniMagic is an AI-powered platform that generates concept art images and 3D models for miniatures and collectibles. The Service uses third-party AI providers including Google Gemini, Tripo3D, and others to generate content.
We do not guarantee the availability, accuracy, quality, or fitness of generated content for any particular purpose. AI-generated outputs may contain errors, artifacts, or unexpected results.
Paid subscribers (Hobby, Creator, Studio): Subject to these Terms and applicable law, you own the content you generate using MiniMagic to the fullest extent possible. You may use your generated content for any lawful purpose, including commercial use — selling prints, merchandise, game assets, or any other application.
Free tier users: You are granted a limited, non-exclusive, non-commercial license to use content generated on the free tier for personal, non-commercial purposes only. Commercial use requires a paid subscription.
Under current U.S. copyright law, purely AI-generated works may not be eligible for copyright registration. "Ownership" as used in these Terms refers to your contractual right to use, distribute, and commercialize the outputs — it does not guarantee copyright protection. Works that involve substantial human creative input (selection, arrangement, modification) may be eligible for copyright to the extent of the human contribution.
By using the Service, you grant MiniMagic a perpetual, worldwide, non-exclusive, sublicensable, royalty-free, irrevocable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from any content you create on or upload to the platform, including but not limited to prompts, images, 3D models, and any other inputs or outputs.
This license allows us to operate, improve, promote, and market the Service, train and develop AI models, create marketing materials, display galleries and showcases, and for any other purpose related to our business. This license survives termination of your account.
MiniMagic does not warrant that generated content will not infringe third-party intellectual property rights. You are solely responsible for ensuring your use of generated content does not violate the rights of others. We provide no indemnification for IP claims arising from your use of generated content.
MiniMagic operates on a credit-based system. Different operations consume different amounts of credits. Credit costs are displayed in the application before each operation.
Paid subscriptions are billed monthly or annually via Stripe. Subscription credits reset on your billing date each month. Unused subscription credits do not roll over. By subscribing, you authorize recurring charges at the applicable rate.
Prices are exclusive of applicable taxes. Sales tax, VAT, or other taxes may be added at checkout based on your location.
One-time credit purchases ("top-ups") never expire and carry over each month. Top-up credits are non-refundable and non-transferable.
You may cancel your subscription at any time through the billing portal accessible from your account settings. Cancellation takes effect at the end of your current billing period. You retain access to paid features until the period expires. No pro-rata refunds are provided for partial billing periods.
Subscription fees and credit purchases are generally non-refundable. If a generation fails due to a service error, credits are automatically refunded to your account. For billing disputes, contact [email protected].
You agree to comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy may result in account suspension or termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Service will be uninterrupted, error-free, secure, or that generated content will meet your requirements or expectations.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINIMAGIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID TO MINIMAGIC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless MiniMagic and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) your generated content.
We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms or the Acceptable Use Policy. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 5.3, 8, 9, 10, and 12) will survive.
Arbitration: Any dispute arising from these Terms or the Service shall be resolved by binding arbitration under the rules of the American Arbitration Association. Arbitration shall take place in the State of Maryland. You may opt out of this arbitration clause within 30 days of first agreeing to these Terms by emailing [email protected].
Class Action Waiver: You agree that disputes will be resolved on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law: These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of law principles.
